Se trata de una reseña de la obra "Filosofía anarquista del Derecho. Un estudio de la idea" publicada en 2018 y cuya autoría corresponde a Benjamín Rivaya García (catedrático de Filosofía del Derecho de la Universidad de Oviedo). En ella se realiza un detenido análisis de lo que el autor denomina "el iusnaturalismo radical anarquista".

Introducción a los estudios de Derecho y Cine, tradicionales en el ámbito anglosajón, pero asi desconocidos en España, que versan sobre las relaciones entre el fenómeno jurídico y el fenómeno cinematográfico. Así, se plantea la posible existencia del género del cine jurídico, así como las relaciones entre la temática jurídica y los diversos géneros cinematográficos, especialmente en el caso del cine negro, del western y del cine político, géneros en los que el dato jurídico está casi necesariamente presente. En el (...) supuesto de que no se reconozca la existencia del cine jurídico, al menos ha de admitirse que muchos argumentos jurídicos han sido típicamente cinematográficos, con lo que no es extraño encontrar en el cine normas, instituciones y desarrollos propios del Derecho Procesal, Penal, Penitenciario, Laboral, Constitucional, Internacional, así como del Derecho Privado, destacando en este caso los asuntos propios del Derecho de familia, y de la filosofía del Derecho. Pero las relaciones entre el Derecho y el cine incluyen también el estudio de las diversas teorías del cine y las repercusiones que éstas tienen en el ámbito jurídico, político y moral. Por último, se apunta la cuestión de la utilidad de los estudios de Derecho y Cine, sobre todo para la didáctica jurídica, que se vería beneficiada por su incorporación al estudio del Derecho. Co‐expression of two or more genes at the single‐cell level is usually associated with functional co‐regulation. While mRNA co‐expression—measured as the correlation in mRNA levels—can be influenced by both transcriptional and post‐transcriptional events, transcriptional regulation is typically considered dominant. We review and connect the literature describing transcriptional and post‐transcriptional regulation of co‐expression. To enhance our understanding, we integrate four datasets spanning single‐cell gene expression data, single‐cell promoter activity data and individual transcript half‐lives. Confirming expectations, we find that positive co‐expression necessitates (...) promoter coordination and similar mRNA half‐lives. Surprisingly, negative co‐expression is favored by differences in mRNA half‐lives, contrary to initial predictions from stochastic simulations. Notably, this association manifests specifically within clusters of genes. We further observe a striking compensation between promoter coordination and mRNA half‐lives, which additional stochastic simulations suggest might give rise to the observed co‐expression patterns. These findings raise intriguing questions about the functional advantages conferred by this compensation between distal kinetic steps. (shrink)

In the comedies of errors, and more precisely in the comedies of double, in which two identities become confused, the characters get into paradoxical situations reigned by the principle of contradiction. The classemic relationships that are based on the criterion of subjectivity are broken due to the intervention of the character appearing as the double, for the doubled and the double can appear as one subject or as two. In fact, in the added double one + one equals one (1 (...) + 1 = 1; Sosia + Mercury = Sosia) and in the split double one equals one + one (1 = 1 + 1; Philocomasium = Philocomasium + Dicea). In the modal oppositions of the alternative class (present | absent, to be | not to be) and in the aspectual oppositions of the sequential class (to arrive – to be in) the intrasubjective nature is cancelled; in the diathetic or complementary oppositions (to give .– to receive) the intersubjective relationship gets broken. Thus, it turns out that, due to the action of the double, a character can be present and absent at the same time, be and not be the same, be in a place before arriving there or have received what another has not yet given him. Background No studies have been conducted in Mexico to ascertain what ethical problems doctors working at hospitals deal with. This article aims to describe the ethical conflicts most commonly identified by Mexican internists and the importance they attribute to each of these conflicts. Methods Voluntary survey to the members of the Internal Medicine Association of Mexico. Results Responses were submitted by 347 internists. Half of those face ethical conflicts almost always or frequently. The most commonplace and relevant conflicts are those (...) resulting from the clinical relationship (communication, confidentiality, informed consent, assessment of mental capacity, decisions involving incapacitated patients, and conflicts with family members), and secondly those problems related with the end of life (palliative care, withholding or withdrawing treatment, and “No CPR orders”). To resolve conflicts they seek support through protocols, Institutional Ethics Committees (IECs), and consultations with colleagues and, occasionally, with bioethics experts. Protocols and IECs are the tools most in demand among them. Conclusions 1) the most frequent and relevant conflicts are those caused by the clinical relationship, above all those due to doctor–patient communication, and secondly those due to problems which arise at the end of life; 2) though nearly all of them have doubts about how to resolve conflicts, the vast majority are satisfied with the way in which they do so; 3) to deal with conflicts, they seek support mainly in protocols, IECs, and consultation with colleagues; and 4) in order to resolve them better, what they most demand are protocols and IECs, but also bioethics consultants. Background Ethical conflicts generate difficulties in daily clinical activity. Which methods of ethical advice are most frequently used to resolve them among Spanish doctors has not been studied. The objective of this study is to describe what methods hospital internal medicine physicians in Spain use to resolve their ethical doubts and which they consider most useful. Design A cross-sectional observational study was conducted through a voluntary and anonymous survey and distributed through an ad hoc platform of the Spanish Society of (...) Internal Medicine. Measures We measured methods by which to resolve doubts, types of tools sought, frequency of consulting the Clinical Ethics Committees, and satisfaction with resolution of ethical issues. Results Of 261 internists surveyed, 86 per cent resolve their ethical doubts with assistance, the most frequently used method being consultation with colleagues (58.6 per cent), followed by using specific protocols or guides (11.8 per cent) and consultation with experts in bioethics (9.6 per cent). The most preferred tools are the creation of protocols (30.3 per cent) and the establishment of a consultant/expert in bioethics (27.8 per cent). Conclusions Internists in Spain usually seek assistance to resolve their ethical doubts. Consulting colleagues is the most frequently adopted method. The majority regard tools to resolve ethical conflicts as necessary, seeking above all protocols and consultants/experts in bioethics. (shrink)

The differences in clinical bioethics between the Mediterranean and Latin American cultures have not been analyzed. The objective of the study is to compare the ethical conflicts that internists in Spain, Mexico and Argentina have. Cross-sectional observational study through a survey directed at internists from Spain, Argentina and Mexico. The survey was administered to affiliated members of the National Societies of Internal Medicine across three countries via an online platform. 762 internists participated, 261 from Spain, 154 from Argentina and 347 (...) from Mexico. The main ethical conflicts that internists in Spain, Argentina and Mexico have are related (in order) to the end of life, to the clinical relationship and to the patient’s autonomy. Withholding and withdrawing life-sustaining treatment is the most frequent conflict in Spain and Argentina and the second in Mexico. Internists from Spain and Argentina identify very similar ethical conflicts. Furthermore, they consider them more frequent and difficult than in Mexico. In Argentina they are less satisfied with the way they are resolved. To explain these differences, socio-cultural factors are postulated, among others: paternalism, individualism, masculinity, organization of the health system, formal training in bioethics and assessment of death. In the context of technological dissemination sessions aimed at prospective students at the Polytechnic University of Baja California in the city of Mexicali, Baja California, the importance of engineering and its role in scientific and technological progress was stressed, as well as its role in scientific and technological progress as drivers of economic development in the region. A group of 2,154 students from 20 different institutions of public high school education answered a survey designed as an evaluation tool for a (...) career path or technology area of interest. The survey results show that students have a low preference for engineering careers. Moreover, these results were augmented with an additional study on the high attrition of students in engineering schools in the city of Mexicali, Baja California, also conducted by the authors. It raises the importance of teaching science in the early education levels, which aims to prepare scientists and technologists needed for the development of research and innovation as a foundation for economic prosperity and welfare of an emerging economy such as Mexico. Both unipolar and bipolar depression have been linked with impairments in executive functioning. In particular, mood symptom severity is associated with differences in common EF, a latent measure of general EF abilities. The relationship between mood disorders and EF is particularly salient in adolescence and young adulthood when the ongoing development of EF intersects with a higher risk of mood disorder onset. However, it remains unclear if common EF impairments have associations with specific symptom dimensions of mood pathology such as (...) blunted positive affect, mood instability, or physiological arousal, or if differences in common EF more broadly relate to what is shared across various symptom domains, such as general negative affect or distress. To address this question, bifactor models can be applied to simultaneously examine the shared and unique contributions of particular mood symptom dimensions. However, no studies to our knowledge have examined bifactor models of mood symptoms in relation to measures of common EF. This study examined associations between common EF and general vs. specific symptom dimensions using structural equation modeling in adolescents and young adults with varying severity of mood symptoms. A General Depression factor capturing shared variance across symptoms statistically predicted lower Common EF. Additionally, a factor specific to physiological arousal was associated with lower Common EF. Anhedonia-specific and Mania-specific factors were not significantly related to Common EF. Altogether, these results indicate that deficits in common EF are driven by, or reflect, general features of mood pathology that are shared across symptom dimensions but are also specifically associated with physiological arousal. In Older Adults (OAs), Electroencephalogram (EEG) slowing in frontal lobes and a diminished muscle atonia during Rapid Eye Movement sleep (REM) have each been effective tracers of Mild Cognitive Impairment (MCI), but this relationship remains to be explored by non-linear analysis. Likewise, data provided by EEG, EMG (Electromyogram) and EOG (Electrooculogram)—the three required sleep indicators—during the transition from REM to Non-REM (NREM) sleep have not been related jointly to MCI. Therefore, the main aim of the study was to explore, with (...) results for Detrended Fluctuation Analysis (DFA) and multichannel DFA (mDFA), the Color of Noise (CN) at the NREM to REM transition in OAs with MCI vs. subjects with good performances. The comparisons for the transition from NREM to REM were made for each group at each cerebral area, taking bilateral derivations to evaluate interhemispheric coupling and anteroposterior and posterior networks. In addition, stationarity analysis was carried out to explore if the three markers distinguished between the groups. Neuropsi and the Mini-Mental State Examination (MMSE) were administered, as well as other geriatric tests. One night polysomnography was applied to 6 OAs with MCI (68.1 ± 3) and to 7 subjects without it (CTRL) (64.5 ± 9), and pre-REM and REM epochs were analyzed for each subject. Lower scores for attention, memory and executive funcions and a greater index of arousals during sleep were found for the MCI group. Results confirmed that EOGs constituted significant markers of MCI, increasing the CN for the MCI group in REM sleep. The CN of the EEG from the pre-REM to REM was higher for the MCI group vs. the opposite for the CTRL group at frontotemporal areas. Frontopolar interhemispheric scaling values also followed this trend as well as right anteroposterior networks. EMG Hurst values for both groups were lower than those for EEG and EOG. Stationarity analyses showed differences between stages in frontal areas and right and left EOGs for both groups. These results may demonstrate the breakdown of fractality of areas especially involved in executive functioning and the way weak stationarity analyses may help to distinguish between sleep stages in OAs. In this paper, we delimit the moments in which, in “Doctrine of the Similar” and in “On the Mimetic Faculty”, reading and Sprache (speech, language, language) are inseparably linked to the category of “non-sensuous similarities.” In this conception, the analogical-proportional representation of traditional mimesis is dislocated by a rhetori- cal conception of symbolic experiences given by different semiotic forms. Moreover, the idealist ground of the symbolic is relocated in the specific area of language, in which the perception of similarities is (...) mediated by the instance of reading under the predominance of the dissimilar. Our fundamental purpose resides in exposing how this production of similarities, in contrast to those of the relational schematism of classical logicism and with the ground of idealistic determination of Kantian aesthetics, shows its paradoxical grounds in the mimetic reading. In this paper we articulate, partially and from a rhetorical analysis approach, the crucial moments in which reading appears linked to die Sprache in Walter Benjamin's writings. Both reading and die Sprache operate in Benjamin's discourses as a point of synecdochic crystallization for the elaboration of his rhetorical critique, already outlined in his posthumous writings of youth and brought into play in his early and late essays on art criticism. El presente trabajo se propone analizar el desvío retórico que hace Walter Benjamin en su lectura de la crítica kantiana a la metafísica. En función de ello, mediante una vía de interpretación expositiva, abordaremos cómo se sitúa lo retórico en el marco de una tarea crítica que busca ampliar los dominios transcriptos de la experiencia posible hacia un trasfondo incondicionado, no reducible bajo el ideal sistemático de la _Wissenschaft_ y sus primados de tipo metafísico-gnoseológico. A partir de la exposición de (...) los vínculos entre crítica retórica, _Sprache_ y el uso retórico de figuras teológicas en algunos contextos discursivos de las disquisiciones benjaminianas, arribaremos a las consideraciones finales, en las que planteamos que el desvío retórico de la crítica efectuado por el autor resulta inseparable de una crítica radical al estatuto del discurso filosófico sistemático y a su fundamento de determinación idealista, concebida mediante una reinvención de categorías y problemas estéticos. En el presente trabajo se propone analizar la apropiación que hace Walter Benjamin del criticismo kantiano para la construcción de una filosofía contemporánea venidera. En función de ello, mediante una vía de interpretación expositiva, abordaremos cómo se articula en “Sobre el programa de la filosofía venidera” el pasaje de la crítica a la metafísica hacia una crítica de tipo retórico, considerando los momentos siguientes: la doble articulación del significante Lehre (entendido en su acepción teorético-doctrinal —tal como funciona en el discurso (...) de las filosofías de sistema— o en su fundamento retórico —Lehre como enseñanza, transmisión o comunicación indirecta—), la ampliación del campo de la experiencia concebido en el ámbito de die Sprache y la interpretación de la metafísica crítica en cuanto mitología moderna. A partir de la exposición de estos momentos, arribaremos a las consideraciones finales de que la apropiación de Benjamin del criticismo como punto de partida para la constitución de una filosofía contemporánea venidera, en contraposición con el ideal epistémico de la Lehre entendida bajo una interpretación teórico-doctrinal, resulta inseparable de una crítica radical al estatuto del discurso filosófico sistemático y a su fundamento de determinación idealista. This paper uses tools of philosophical analysis critically to examine accounts of the nature of racism that have recently been offered by writers including existentialist philosopher Lewis Gordon, conservative theorist Dinesh D'Souza, and sociologists Michael Omi and Howard Winant. These approaches, which conceive of racism either as a bad-faith choice to believe, a doctrine, or as a type of 'social formation', are found wanting for a variety of reasons, especially that they cannot comprehend some forms of racism. I propose an (...) account that conceives racism chiefly as a motivational/volitional matter, in short, as a form of moral viciousness. I show how this approach offers a unified account that comprises inter alia individual and institutional racism, expressed and unexpressed racism. I point out advantages that my view has over Thomas Schmid's somewhat similar suggestion, and use the account to examine a number of claims made about racism by H. L. Gates, Jr, Elizabeth Young-Bruehl, Gertrude Ezorsky, and others. Finally, I defend this approach from the general criticism that Benjamin DeMott has levelled against any effort so to understand racism. Este artículo de homenaje a la Profesora Yolanda Ruano se divide en dos partes. En la primera discuto las críticas que ella realizara a mi libro sobre la diosa Fortuna en las que avanzaba su propio análisis de las complejas relaciones entre razón y fortuna en el pensamiento occidental. En la segunda parte, desde el punto de vista del “giro icónico” en humanidades y ciencias sociales, analizo el caso concreto del auge y desaparición de la diosa Fortuna en la iconografía (...) política de la ciudad de Berlín. A lo largo del siglo XIX la diosa Fortuna desaparece de la escena berlinesa y es sustituida por la diosa Niké o Victoria, que popularmente se interpreta como un Ángel de la Victoria. Este es el marco de la infancia de Walter Benjamin, quien más tarde expresará su visión de la historia con un otro ángel completamente distinto, el Angelus Novus de Paul Klee. (shrink)

This paper discusses hope and hopelessness in relation to history. It does so by turning to Benjamin’s famous statement that hope exists only for the hopeless, and to Derrida’s late thoughts on solitude and the world.

This paper establishes a critical relationship between the concepts of memory and experience in the writings of Walter Benjamin, as a preliminary step to expose the negative philosophy of the same author –conceived in terms of remembrance and redemption. This conceptual framework is necessary to propose a Benjaminian negative anthropology that rejects formal anthropological universality and the effort to impose a human ideal that must be achieved by all human beings.

The 2016 US Election and its aftermath have renewed anti-racist activism on the American left. This article takes a close look at familiar philosophical analyses of racism and argues that they have two shortcomings: (1) they do not offer proper guidance in combating racism, and (2) they do not adequately represent the historical relationship between race and racism. A different view of racism, one that adopts a genealogical, as opposed to analytical, approach is laid out. And it is argued that (...) this view is better able to account for what racism is and to guide the anti-racist response called for by current events. (shrink)

The present work proposes to analyze the dialectic between allegory and symbol elaborated from Walter Benjamin's rhetorical-aesthetic reading of the artistic form of the German Trauerspiel. Based on this, through a way of expository interpretation, we will address how the following three key moments are articulated in the book on the German Trauerspiel: the link between the Trauerspiel and the profane scene of reading, the particularity of allegorical signification, and the inseparability of allegory and mourning. From the exposition of these (...) moments, we will arrive at some final considerations: within the field of the philosophy of art, the dialectic between allegory and symbol constitutes a rhetorical-aesthetic conception of meaning (Bedeutens), thought through a double characterisation that Benjamin finds in die Sprache. This article, based on grandparents' narratives collected in a doctoral research project, aims to weave together reflections on childhood, intergenerational bonding, and love. Seven grandmothers and three grandfathers, between fifty-one and seventy-one years old, participated in the research; nine residents of the city of Rio de Janeiro and one of Niterói, Brazil. In addition, narratives were collected from six of their grandchildren, all of them between five and twelve years old, and residents of Rio de Janeiro, Niterói, Brasília and Montevideo, (...) Uruguay. Conducted during the Covid-19 pandemic, our methodological strategy involved interviews conducted on Zoom. Interviews with the adults were conducted individually, and collectively with the children. The themes that emerged in the grandparents' narratives led to reflections on the relationship between adults and children that are emblematic of the conception of childhood found in Walter Benjamin's work, as well as the philosophical anthropology of Martin Buber and the psychoanalysis of Donald Winnicott. The emphasis of the research participants was on affective security, built on the basis of small, everyday gestures, which result in an atmosphere of mutual support between children and adults. From these affectionate encounters between the youngest and the oldest, what we characterize as a “childlike force” is established—an energy field that produces new existential possibilities. The narratives collected here teach us new ways of being adult through our relationships with children: in our encounter with the lifeworlds of the youngest among us, we re-encounter our own deeper sensibilities, and regain the ability to play, to create, and to reinvent ourselves in relearning the joy of beginnings. For many, it was anxiety and uncertainty that “knock[ed] at the door”; for others, however, those same feelings of unease prompted one of hopefulness: reflecting on the possibilities for resilience and regeneration in the process of changing our vision of the world.1 The Knock at the Door conference brought contemporary utopianism to the forefront of thinking about how to respond to global crises while remaining attentive to other adversities of daily life. Scholars and artists answered the knock in an attempt to examine paths toward utopia, and to take advantage of the regenerative and resilient potential of the present.The conference was the culmination of author/activist Larissa Lai’s fellowship period at the University of Huelva. The 2022–23 María Zambrano Fellowship for the academic year2 allowed Lai to complete the project “Utopian Dreams for Post-Covid Times,” carried out in collaboration with the Huelva research group led by Professor Pilar Cuder-Domínguez, who hosted a number of online and in-person seminars on speculative fiction with Lai. The Knock at the Door conference, marking the end of Lai’s fellowship, created yet another space for scholars, artists, and critics to discuss the potential of utopian narratives. Lai asks: “What does our cultural moment require, and how can we get where we need to go from where we are? How can literature, especially speculative fiction literature, help us get from here to there?”3 [End Page 641] The intention of the conference was to encourage others to continue Lai’s work on how to imagine futures where human and posthuman beings need to remain vigilant to adversities. Utopian scholars, among others, might find the complications of “getting there from here” closely related to Lai’s conception of “insurgent utopias,” or “emergent insurgency.” They could find Lai’s concept of “insurgent utopianism” interesting as it lays the foundations of futurity in terms of crisis responses.The aim of the conference was to explore the imagination of better futures through utopian thinking and practice. In addition, it focused on “the knock at the door,” which is “a moment of contingent arrival... open to cooptation, destruction, bastardization, incorporation, death, or defusal.” Yet, it presents “the powerful possibility of critique—narratively or discursively, in its very materiality.”4 One way of doing this might be to look back at the past century of utopianism and ask who or what has been missing. The conference took up Lai’s idea of insurgent utopianism as a method of paving a path toward a multitude of dreams and actions, all shaped by the unique circumstances of one’s positionality.After the COVID-19 pandemic, the need for utopian thinking has become more pressing than ever. New horizons of hope must be created in the face of emerging anxieties. Panelists Benjamin Ghan and Marc Lynch reflected on how creative writers envision ideal worlds and temporalities. In Ghan’s view, utopian narratives create a symphony of voices historically excluded from the category of “the human”: women; LGBTQ+ people; Indigenous peoples. In a similar vein, Lynch described his own novel, A Wasp’s Waist, as highlighting the impossibility of imagining utopias within the capitalist paradigm—and thus the necessity of imagining futures beyond capitalism, and beyond... Partiendo de la recurrencia del motivo de la pobreza de la experiencia en el marco de la Teoría crítica y su entorno más afín, nos proponemos tematizar la equivocidad que presenta el mismo mediante la delimitación de sus diferentes sentidos en Adorno, Horkheimer y Benjamin. Ello nos permitirá dejar esbozadas las líneas generales de una problemática que, a nuestro entender, es producto de cierta complementariedad pero a la vez tensión entre dichos sentidos.

El presente artículo resume los fundamentos de la teoría estética formulada por Luigi Pareyson. La materia y la forma constituyen la obra y en ellas se da una unión entre lo espiritual y lo material mostrando la esencia de lo bello-verdadero en la trascendencia. La percepción de los sentidos y la interacción materia-espíritu nos llevará a las fuentes de la experiencia estética en tanto que experiencia del ser. Arvo Pärt lo manifestará así en Berliner Messe y Cantus in memoriam of (...) Benjamin Britten. La forma abre la materia al espíritu y el espíritu abre el arte a la trascendencia. (shrink)

Este artículo de homenaje a la Profesora Yolanda Ruano se divide en dos partes. En la primera discuto las críticas que ella realizara a mi libro sobre la diosa Fortuna en las que avanzaba su propio análisis de las complejas relaciones entre razón y fortuna en el pensamiento occidental. En la segunda parte, desde el punto de vista del “giro icónico” en humanidades y ciencias sociales, analizo el caso concreto del auge y desaparición de la diosa Fortuna en la iconografía (...) política de la ciudad de Berlín. A lo largo del siglo XIX la diosa Fortuna desaparece de la escena berlinesa y es sustituida por la diosa Niké o Victoria, que popularmente se interpreta como un Ángel de la Victoria. Este es el marco de la infancia de Walter Benjamin, quien más tarde expresará su visión de la historia con un otro ángel completamente distinto, el Angelus Novus de Paul Klee. (shrink)

In this book Alexander García Düttman explores and expands the works of Heidegger, Rosenzweig, Adorno, Benjamin, and Derrida. Out of his very fresh and pointed re-reading, he uncovers a peculiar correspondence of obsessions, interests, and priorities between these diverse twentieth century philosophies, And from these discoveries Düttman details a singular philosophical theory of memory and promise. Düttman's methodology is as groundbreaking as his discoveries, Alan Udoff writes: "This is not an exposition in the conventional sense: a scholarly, historical report, (...) with some attempt at criticism, Rather, it is at every turn a thinking through of certain texts, a thinking that, in putting questions to the texts... reveals or releases what is... stored in those texts." Düttman's questions are so philosophically and theologically penetrating that the reader is set out in new direction of thinking. While Düttman's book helps the reader achieve a new understanding of the gift of language in the works of Adorno, Benjamin, Heidegger, and Rosenzweig, his study also is fraught with implications for reading Derrida, Deleuze, Levinas and Lyotard. Though La parole donnee memoire et promisse, published in 1989 by Editions Galilee, was the first book Garcia Duttmann's (German, Middlesex U., England) wrote, and he has developed many of its ideas more fully in subsequent works, he has chosen to make few changes for the translation. Most proponents of conscientious objection accommodation in medicine acknowledge that not all conscientious beliefs can justify refusing service to a patient. Accordingly, they admit that constraints must be placed on the practice of conscientious objection. I argue that one such constraint must be an assessment of the reasonability of the conscientious claim in question, and that this requires normative justification of the claim. Some advocates of conscientious object protest that, since conscientious claims are a manifestation of personal beliefs, they cannot (...) be subject to this kind of public justification. In order to preserve an element of constraint without requiring normative justification of conscientious beliefs, they shift the justificatory burden from the belief motivating the conscientious claim to the condition of the patient being refused service. This generally involves a claim along the lines that conscientious refusals should be permitted to the extent that they do not cause unwarranted harm to the patient. I argue that explaining what would constitute warranted harm requires an explanation of what it is about the conscientious claim that makes the harm warranted. ‘Warranted’ is a normative operator, and providing this explanation is the same as providing normative justification for the conscientious claim. This shows that resorting to facts about the patient’s condition does not avoid the problem of providing normative justification, and that the onus remains on advocates of conscientious objection to provide normative justification for the practice in the context of medical care. “Sophisticated” theories of welfare face two potentially devastating criticisms. They are based upon two claims: that theories of welfare should be tested for what they imply about newborn infants and that even if a theory of welfare is intended to apply only to adults, we might still have sufficient reason to reject it because it implies an implausible divergence between adult and neonatal welfare. It has been argued we ought reject sophisticated theories of welfare because they have significantly counterintuitive implications (...) about neonatal welfare and because they imply an implausible divergence between the welfare of adults and that of newborns. ABSTRACTPrior research has found a relationship between perceived facial attractiveness and perceived personal trustworthiness. We examined the time course of attractiveness relative to trustworthiness evaluation of emotional and neutral faces. This served to explore whether attractiveness might be used as an easily accessible cue and a quick shortcut for judging trustworthiness. Detection thresholds and judgment latencies as a function of expressive intensity were measured. Significant correlations between attractiveness and trustworthiness consistently held for six emotional expressions at four intensities, and neutral (...) faces. Importantly, perceived attractiveness preceded perceived trustworthiness, with lower detection thresholds and shorter decision latencies. This reveals a time course advantage for attractiveness, and suggests that earlier attractiveness impressions could bias trustworthiness inferences. Origin of the German Trauerspiel was Walter Benjamin's first full, historically oriented analysis of modernity. Readers of English know it as "The Origin of German Tragic Drama," but in fact the subject is something else--the play of mourning. Howard Eiland's completely new English translation, the first since 1977, is closer to the German text and more consistent with Benjamin's philosophical idiom. Focusing on the extravagant seventeenth-century theatrical genre of the trauerspiel, precursor of the opera, Benjamin identifies allegory as the constitutive (...) trope of the Baroque and of modernity itself. Allegorical perception bespeaks a world of mutability and equivocation, a melancholy sense of eternal transience without access to the transcendentals of the medieval mystery plays--though no less haunted and bedeviled. History as trauerspiel is the condition as well as subject of modern allegory in its inscription of the abyssal. Benjamin's investigation of the trauerspiel includes German texts and late Renaissance European drama such as Hamlet and Calderón's Life Is a Dream. The prologue is one of his most important and difficult pieces of writing. It lays out his method of indirection and his idea of the "constellation" as a key means of grasping the world, making dynamic unities out of the myriad bits of daily life.
